In case of dispute over the standard of the architectural companies rendered or of the unethical conduct of the Architect/ RLA, the venue for an administrative complaint in opposition to an Architect is the Professional Regulation Commission (below its administrative proceedings). This Agreement is just for CONCEPTUAL Architectural and Engineering (CA&E) Design Services below the 2010 SPP, whereby the Philippine registered and licensed Architect (RLA, or the “Architect”) gives the required CA&E Design Services i.e. the Architect brings in all the Design Engineers as part of his Design Team. Under 2010 SPP, the proportion (%) shall be primarily based on the type of the Project or the scope of the skilled companies being contracted by the Architect i.e. CONCEPTUAL A&E Design Services as compared to the total Regular or Basic Detailed Architectural (DA) Services with Periodic Construction Supervision (PCS) Services. 3. Under CA&E, the Architect’s Fee is computed at only forty % (40.0%) of the allowed Basic Fee multiplier for Detailed A&E Services as utilized to the Statement of Probable Project Construction Cost (SPPCC) that should be prepared by the Architect and annexed to this Agreement. Upon the completion of the Schematic Design Services, but not more than 15 days after submission of the Schematic Design Report back to the Owner, a sum equal to sixty percent (60.0%) of the Component Fee, less the quantity paid below a and b.
Upon the completion of the Project Definition Services, but not greater than 15 days after submission of the Project Definition Report back to the Owner, a sum equal to thirty p.c (30.0%) of the Component Fee, much less the amount paid underneath a. Upon the completion of the Design Development Services, but not more than 15 days after submission of the Design Development Report back to the Owner, a sum enough to extend the overall payments on the charge to at least one hundred percent (100.0%) of the Component Fee, much less the quantity paid under a, b and c.
